Aspen’s Boogie’s Diner closes, suit filed over commission

ASPEN — Boogie’s Diner has served its last meal. The corner building that’s housed the popular eatery is under contract to be sold for $27.5 million, and its owner is being sued for unpaid commission.Late Wednesday, Aspen attorney Matt Ferguson, on behalf of Aspen property broker Shlomo Ben-Hamoo, filed suit against Boogie’s Building of Aspen LLC, which is controlled by Leonard “Boogie” Weinglass, in Pitkin County District Court.The suit claims that Weinglass promised to pay Ben-Hamoo 2 percent commission when the sale of the building closes at the end of April.
